Hotel Merian Terms and Conditions

1. SCOPE OF APPLICATION

These General Terms and Conditions apply to all legal relationships between Hotel Merian and the GUEST. Furthermore, the scope of application extends to any legal relationships between the guest and Hotel Merian, Rheingasse 2, CH-4058 Basel, which, as a marketing and sales company acting on behalf of Hotel Merian, arranges or directly provides the services of the latter.

2. CONCLUSION OF THE CONTRACT

A contract between the GUEST and Hotel Merian is concluded upon receipt of the written, telephone, electronic, or in-person booking and the delivery of the booking confirmation. These General Terms and Conditions are an integral part of this contract. Communications via email are deemed to have been made in writing.

3. BOOKING CONDITIONS

For all bookings not made directly through a booking office of Hotel Merian or its marketing and sales office, Hotel Merian, valid credit card details (valid at least until the planned check-out date) are required. A prerequisite for all bookings is, in principle, acceptance of the terms and conditions set forth herein, as well as agreement to the provisions listed and explained in the Privacy Policy. If these terms and conditions are not complied with, Hotel Merian may cancel the booking without notice. Section 4 below applies regarding cancellation fees. Depending on the booking channel and the time of booking, different restrictions regarding minimum stay and/or availability may apply.

4. CANCELLATIONS AND CHANGES TO BOOKINGS

4.1 General Terms

Cancellations or rebookings are only valid if they are submitted in writing to Hotel Merian and confirmed in writing by Hotel Merian. The following deadlines apply:

- Changes/cancellations up to 7 days prior to arrival are free of charge.
- Changes/cancellations: up to 21 days prior to arrival are free of charge for all

After the deadline has passed, the hotel is entitled to charge for the entire stay. Exceptions are possible by written agreement.

4.2 Deposits

Deposits already paid will be refunded in the form of vouchers.

4.2.2 Separate arrangements
(e.g., for group bookings) may be agreed upon, but must be in writing.

4.3 Cancellation Date and Insurance

The date of the written notice’s receipt by the booking office is decisive for calculating the cancellation date. In cases of hardship, cancellation costs may be covered by cancellation insurance, provided the GUEST has taken out such coverage.

4.4 Providing a Replacement

If the booked arrangement cannot be utilized, Hotel Merian will accept a substitute who assumes the existing booking under the same conditions. The substitute must be notified to Hotel Merian in a timely manner (prior to arrival). The original GUEST remains the contracting party and is liable.

4.5 Cancellation Due to Force Majeure

In cases of force majeure, such as political unrest, strikes, natural disasters, etc., Hotel Merian may cancel the reservation at short notice for safety reasons. In such cases, the GUEST will receive a refund of the amount paid in the form of a voucher.

4.6 Disturbances and Operational Restrictions

Disruptions such as noise and/or operational restrictions do not entitle the GUEST to any compensation or refund.

4.7 “Non-refundable Rates” / “Prepaid Rate”

If the guest has chosen this specific type of room reservation, the booking is only final once full payment has been received by Hotel Merian. These reservations cannot be canceled except in cases of force majeure.

5. PRICE CHANGES

Hotel Merian may change the advertised prices in the following cases:
clearly explainable printing or typographical errors
exchange rate changes (converted according to Hotel Merian’s daily rate)
newly introduced or increased government taxes (e.g., value-added tax, visitor’s taxes, etc.)
If, after the contract has been concluded, the prices for the booked service change (for reasons other than those listed above), this has no bearing on the concluded contract, regardless of whether the price has increased or decreased.

6. LIABILITY FOR DAMAGES AND LIABILITY

Hotel Merian is liable for damages only in cases of intent or gross negligence. Liability for personal belongings is excluded to the extent permitted by law.
Claims must be submitted in writing to Hotel Merian immediately, no later than 3 days after departure. Otherwise, the claims are deemed forfeited.

7. USE OF HOTEL ROOMS

The GUEST must use and treat the hotel room with the utmost care. It may only be used or occupied by the number of persons (including children) specified in the contract. The GUEST is not permitted to allow third parties to use hotel rooms rented at the Hotel Merian.
The GUEST is liable for any damages, unless they can prove that such damages occurred through no fault of their own (or of co-users). Damages must be reported to the hotel immediately.

8. CHECK-IN AND CHECK-OUT

Unless otherwise expressly agreed between the contracting parties, the earliest check-in on the day of arrival is at 3:00 PM, and the latest check-out on the day of departure is by 11:00 AM.

9. DATA PROTECTION

Both Hotel Merian and Merian Basel, as the commissioned marketing and sales company, process data in accordance with the Swiss Federal Act on Data Protection (DSG) and the European General Data Protection Regulation (GDPR). The unified privacy policy of both companies is considered an integral part of the General Terms and Conditions. 

10. APPLICABLE LAW AND JURISDICTION

Swiss law applies exclusively to all contracts concluded with Hotel Merian under these General Terms and Conditions. The exclusive place of jurisdiction for any disputes arising from such contracts is Basel.
